Directive 99/92/EC (‘ ATEX 137 ‘ or the ‘ATEX Workplace Directive’) refers to minimum requirements for improving the health and safety protection of workers at risk from explosive atmospheres. The product directive ATEX 95 or 94/9/EC is addressed to those who design, manufacture or sell any equipment intended for use in potentially explosive atmospheres. The workplace safety directive ATEX 137 or 1999/92/EC is addressed to employers. The user Directive, ATEX 137, is implemented by HSE under The Dangerous Substances and Explosive Atmospheres Regulations 2002 (DSEAR). ATEX 137 concerns worker health and safety in those workplaces where potentially explosive atmospheres may be present. The two directives are also known as ATEX 100a and ATEX 137 because they refer to earlier paragraphs (§100a and §137) developed by the EC. The 94/9/EC, “Equipment directive”, does not only apply to electrical equipment but also ALL mechanical equipment. The 1999/92/EC, “Work area directive”, describes the requirements on the company or manufacturer; and ATEX 137, which focuses on the end user’s obligations.
